OSUN STATE, NIGERIA - The Chief Magistrate’s Court sitting in Osogbo, Osun State, has ordered the prosecution of a police officer, CPL Bankole Olumide, for perjury after finding contradictions in two affidavits filed in separate remand applications.

The order was made by Chief Magistrate A. A. Adeyeba in Suit No. MOS/M.921/2026, involving the Commissioner of Police as applicant and four respondents: Adeniyi Ahmed, Sikuru Oyebode, Ogunniyi Tunmise and Lukman Ayuba. The ruling was issued on September 22, 2026.

According to the court, the fresh application was a duplication of an earlier application filed on September 3, 2026, in Suit No. MOS/M.845/2026, in which an order had been made on September 4, 2026, concerning the first three respondents.

The court expressed concern that the police had filed another application instead of charging the respondents to court or releasing them on bail, describing the fresh application as a duplication of the earlier proceedings.

The Magistrate further held that the Commissioner of Police, being a lawyer, ought to have been aware of the issue, but that his officers had instead filed applications and affidavits containing duplicated facts.

The court subsequently dismissed the fresh remand application for being an abuse of court process and warned the Osun State Police Command against misleading any court in the state.

The court also ordered the immediate release of the first, second and third respondents, directing the police to either release them or charge them to court. The fourth respondent, Lukman Ayuba, was ordered to be released on bail or charged to court on Friday, September 25, 2026.

In a further directive, the Magistrate ordered that CPL Bankole Olumide, the deponent to the affidavit in support of the application, be charged for perjury.

The court specifically directed that his affidavit in Suit No. MOS/M.845/2026 be compared with paragraph 8 of the affidavit in Suit No. MOS/M.921/2026 as the basis for the perjury proceedings.
