The Federal High Court sitting in Osogbo has dismissed a suit filed by the Action Peoples Party (APP) seeking the disqualification of the All Progressives Congress (APC) governorship candidate in Osun State, Asiwaju Munirudeen Bola Oyebamiji, from participating in the August 15, 2026 governorship election.
In a judgment delivered on Wednesday in Suit No. FHC/OS/CS/50/2026, Justice Funmilayo Dame-Ajayi held that the suit lacked merit and failed to disclose a reasonable cause of action.
The APP had approached the court to challenge Oyebamiji's eligibility to contest the forthcoming governorship election in the state.
Before addressing the substantive issues in the case, the court considered preliminary objections raised by the respondents. The judge ruled that the plaintiff failed to establish its legal standing (locus standi) to institute the action, noting that the party did not participate in the primary elections conducted by the respondents.
Justice Dame-Ajayi consequently dismissed the suit and described the plaintiff as a "meddlesome interloper" in the matter. The court also awarded costs of ₦200,000 against the APP.
The ruling effectively upholds Oyebamiji's candidacy ahead of the governorship election scheduled for August 15, 2026.
Legal observers note that issues relating to candidate eligibility and party primaries have continued to generate litigation in the lead-up to the Osun governorship poll, with courts frequently called upon to determine disputes involving political parties and candidates.
The judgment represents the latest in a series of legal contests connected to the state's evolving political landscape as political parties intensify preparations for the election.
