The Court of Appeal sitting in Abuja has taken fresh procedural steps in the ongoing legal dispute over the tenure of Osun State local government chairmen elected on the platform of the All Progressives Congress (APC).

At Monday’s proceedings, September 28, 2026, the interlocutory appeals connected to the matter were reportedly withdrawn and subsequently dismissed by the appellate court.

However, the substantive appeal challenging the judgment of the Federal High Court in Osogbo was not heard, as the Court of Appeal adjourned the matter after it was established that not all the parties involved had been served with the necessary court processes.

The Federal High Court in Osogbo had, on June 15, 2026, dismissed the suit seeking an extension of the tenure of the APC local government chairmen and councillors.

In its judgment, Justice Adefunmilola Demi-Ajayi held that the three-year tenure of the affected elected officials had expired in October 2025.

Following the judgment, the APC and the affected officials proceeded to the Court of Appeal to challenge the decision. The appellate court had subsequently fixed September 28, 2026, for proceedings in the matter.

With the substantive appeal now adjourned, the challenge to the Federal High Court’s final judgment remains pending before the Court of Appeal.

The latest development is procedural and does not constitute a final determination of the substantive appeal. The matter is expected to resume after all outstanding parties have been properly served with the relevant court processes.

The case remains a subject of significant interest in Osun State because of its implications for the status of the affected local government officials and the administration of the state’s councils.
